Consumer Health Data Privacy Notice

Compass Maternal LLC ("Compass Maternal," "we," "us," or "our") respects the privacy of information relating to your health, pregnancy, maternity care, reproductive health, and gynecologic health. This Consumer Health Data Privacy Notice ("Notice") describes how we collect, use, disclose, and protect consumer health data and the rights that may be available to you under applicable state consumer health privacy laws.

This Notice supplements our general Privacy Policy. It applies to consumer health data that is subject to applicable state consumer health privacy laws and is not intended to replace any rights or protections available under other applicable law.

1. CONSUMER HEALTH DATA WE COLLECT

Depending on the services you request and the information you choose to provide, Compass Maternal may collect consumer health data, including information relating to pregnancy, reproductive and gynecologic health, maternity care, and childbirth; pregnancy status, estimated due date, pregnancy history, and birth preferences; information regarding health conditions, symptoms, medications, testing, treatment, or other health-related matters that you choose to provide; information concerning your healthcare providers, facilities, appointments, or healthcare services; information concerning healthcare options, testing, resources, or services you are considering or receiving; information you provide in questionnaires, forms, communications, consultations, or other interactions with Compass Maternal; and other information that may identify or reasonably be used to infer information about your health, pregnancy, gynecologic or reproductive health, or healthcare needs.

Compass Maternal provides non-clinical maternity and gynecologic health education and navigation services. We do not diagnose or treat medical conditions or make medical decisions on your behalf.

2. SOURCES OF CONSUMER HEALTH DATA

We collect consumer health data primarily directly from you; from communications and interactions between you and Compass Maternal; from forms, questionnaires, or other materials you submit; from healthcare providers or other persons when you ask or authorize them to provide information to us; and from service providers that assist us in providing services you have requested.

3. HOW WE USE CONSUMER HEALTH DATA

We may collect and use consumer health data as reasonably necessary to provide the services you request, including to provide maternity and gynecologic health education, navigation, research, and support services; understand your needs, preferences, and circumstances; assist you in identifying and evaluating healthcare resources, providers, facilities, testing options, or other resources; assist with birth preferences, maternity planning, relocation, travel, or other services included within the scope of our services; communicate with you regarding your services; respond to your questions and requests; maintain appropriate business and service records; protect the security and integrity of our services and information systems; and comply with applicable law and legal obligations.

We may also use consumer health data for other purposes with your consent or as otherwise permitted by applicable law.

We will not collect, use, or disclose additional categories of consumer health data or use your consumer health data for materially different purposes without providing any notice or obtaining any consent required by applicable law.

4. HOW WE SHARE CONSUMER HEALTH DATA

Compass Maternal may share consumer health data only as reasonably necessary to provide services you have requested, at your direction or with your consent, or as otherwise permitted or required by law.

Depending on the circumstances, consumer health data may be shared with service providers that support our business operations, communications, technology, data storage, or delivery of services; healthcare providers, facilities, or other resources when you ask us to communicate or share information with them; professional advisers or other persons assisting Compass Maternal who are subject to appropriate confidentiality obligations; and governmental authorities or other persons when disclosure is required or permitted by applicable law.

Service providers that process consumer health data on our behalf are permitted to process that information only as necessary to provide services to Compass Maternal and subject to applicable contractual and legal requirements.

Compass Maternal does not sell consumer health data.

5. ADVERTISING, ANALYTICS, AND TRACKING TECHNOLOGIES

Compass Maternal does not use consumer health data for targeted advertising or permit third parties to use consumer health data collected through our services to build advertising profiles about you.

Our website may use limited technologies necessary to operate, secure, and understand the general use of the website. We do not intentionally permit advertising or analytics technologies to collect information that you provide to us about your pregnancy, reproductive or gynecologic health, medical history, healthcare providers, birth preferences, or other consumer health information for targeted advertising or cross-site behavioral advertising.

We do not use geofencing technology to identify, track, collect information from, or send advertisements or notifications to individuals based on their presence at or near healthcare facilities where prohibited by applicable law.

6. YOUR CONSUMER HEALTH DATA RIGHTS

Depending on the law that applies to you, you may have the right to confirm whether we collect, use, share, or sell your consumer health data; access consumer health data we maintain about you; request correction of inaccurate consumer health data; request deletion of your consumer health data; obtain information regarding third parties or affiliates with whom we have shared your consumer health data; withdraw consent to certain collection, use, or sharing of your consumer health data; and appeal our denial of a request where applicable law provides an appeal right.

You will not be discriminated against for exercising rights available to you under applicable consumer health privacy laws.

7. HOW TO EXERCISE YOUR RIGHTS

You may submit a consumer health data privacy request by contacting us using the information provided in Section 11 below. Please describe your request with sufficient detail for us to understand and respond to it. We may take reasonable steps to verify your identity before processing a request. If an authorized agent submits a request on your behalf, we may request information reasonably necessary to verify the agent's authority.

We will respond to verified requests within the time required by applicable law.

If we deny a request and applicable law provides you with a right to appeal, you may submit an appeal using the contact information in Section 11 and stating that you are appealing our decision.

8. DELETION REQUESTS

If you request deletion of your consumer health data, we will delete covered consumer health data as required by applicable law and will notify applicable service providers, processors, or other third parties where required to do so.

We may retain information when retention is permitted or required by applicable law, including where reasonably necessary to comply with legal obligations, establish or defend legal claims, protect security, prevent fraud or misuse, or otherwise exercise or defend legal rights.

9. SECURITY AND ACCESS

Compass Maternal maintains reasonable administrative, technical, and physical safeguards designed to protect consumer health data from unauthorized access, acquisition, disclosure, alteration, or destruction.

Access to consumer health data is limited to persons and service providers who reasonably need access to perform services or business functions and who are subject to appropriate confidentiality and data-protection obligations.

10. CHANGES TO THIS NOTICE

We may update this Notice periodically to reflect changes in our practices, services, or applicable law. We will post the updated Notice on our website and revise the Effective Date below.

If a change materially affects how we collect, use, or share consumer health data, we will provide any additional notice and obtain any consent required by applicable law before applying the change to your consumer health data.
